· The legislative gives and takes away the powers of the office of notary public.
· Legislators must constantly be reminded of why notaries in Louisiana have been, and should continue, to serve the citizens of Louisiana under Louisiana’s civil law tradition.
· Notaries have held a high place in our legal system for over 300 years.
· Commercial interests continue their efforts to marginalize the office of notary.
· Over the past decade, there have been repeated attempts to create second-class notaries.
· In 2011, legislation was proposed to create an ex officio financial institution notary to handle work for the banks and their customers.
Due to the efforts of the LNA, the legislation HCR 45, was killed!
2012 will be an important year for all notaries.
As a result of recommendations from a legislative notary study committee, legislature will be debating the adoption of continuing education requirements.
The debate will also address who instructs notary preparation courses.
Possible issues to be addressed by legislators are:
· The suspension and/or revocation of commissions
· Minimum requirements for taking the notary exam
